TERMS AND CONDITIONS OF VILLA RENTAL
When you make a reservation, you will receive a Vacation Rental Confirmation/Invoice from Peace of Mind Villa, LLC requesting your deposit on Peace of Mind Villa (“POMVilla”). This Vacation Rental Confirmation becomes a binding agreement when you send Peace of Mind Villa, LLC your rental deposit; it states the terms and conditions concerning this villa rental between you (the “Guest”) and Peace of Mind Villa, LLC (“POMVilla”). Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed below and authorizing Peace of Mind Villa, LLC to apply any penalties or additional costs to the credit card on file. No subletting to another party is permitted. If you have any problems or questions with any of the preceding, please be sure to contact Peace of Mind Villa, LLC BEFORE you send us your rental deposit monies.
ERRORS & OMISSIONS
Peace of Mind Villa, LLC is not responsible for printing or publishing errors, inadvertent omissions or errors, or for the content of any other websites. All rates and villa details are subject to change without prior notice.
PROPERTY
Peace of Mind Villa, LLC and Property Manager reserve the right to refuse service to anyone at their complete discretion. Peace of Mind Villa, LLC and Property Manager will not be responsible for any accident, injury, or loss of money, jewelry, or valuables of any kind whether lost, stolen or left behind. The property will not be rented to anyone under 21 years of age unless part of or Guest of a family group. Guest agrees to use the premises exclusively as a private residence and in compliance with local municipal ordinances, board of fire underwriters’ rules and regulations, and for lawful purposes only. Guest shall not use or permit to be brought into Peace of Mind Villa (“POMVilla”) any illegal substances, explosives or articles deemed hazardous to life, limb or property. In the event the premises are used at any time for unlawful purposes, Guest and all occupants will be removed from the property without refund of any funds.
OCCUPANCY TAX
Peace of Mind Villa, LLC is subject to a USVI Occupancy Tax of 12.5%. This tax is subject to change at any time.
FORCE MAJEURE
We highly recommend travel cancellation insurance. We accept no responsibility for, and shall not be liable in respect of loss or changes caused by Force Majeure, e.g. strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Government actions, Terrorist Activity, or any other event beyond our control.
HURRICANES
In the unlikely event that we should experience a hurricane, we do not allow Guests to remain in our villa during hurricanes. Under a RED ZONE Hurricane all Guests will need to vacate the villa premises within 8 – 10 hours so that staff can begin closing the villa. IMPORTANT: Contact the POMVilla Management to let us know the time you will be departing the villa.
PREMIUM DATES
Rentals for Christmas/New Year’s must be paid in full by September 30th. If you make a reservation on or after October 1st for the upcoming Christmas/New Year’s period, payment in full is required at the time of your reservation. There will be NO refunds given for Christmas/New Year’s rental cancellations made after October 1st.
PAYMENT AND CANCELLATION POLICIES
Your deposit of one-half of the total rent must be received by Peace of Mind Villa, LLC within 5 days of booking. Failure to make this payment subjects your reservation to automatic cancellation without notice to you. The balance due of rent, Government Hotel Tax, and refundable damage deposit must be paid in full at least 60 days prior to your arrival – NO exceptions. Only ONE credit card will be accepted from a rental party for villa payment.
All cancellations and any request for changes to your reservation (such as date changes or changes in the number of persons) must be submitted IN WRITING, and sent to Peace of Mind Villa, LLC by email. No-shows, late arrivals, a reduction in number of persons in your group within 45 days of or after your arrival, and early departures from your villa are non-refundable. No subletting to another party is permitted.
No refunds will be granted unless there is a serious problem which cannot be remedied within 48 hours, and/or which causes the Guest extreme, undue discomfort or serious inconvenience (see also Complaints and Maintenance, below). Guests who abandon their villa without permission from Peace of Mind Villa, LLC agree they have no rights to compensation.
If you cancel more than 60 days prior to your arrival date (PREMIUM DATES more than 90 days), 100 percent of your total payment will be refunded to you.
If you cancel between 30 and 60 days of your arrival date, you will receive back 50 percent of your payment made (PREMIUM DATES are non-refundable).
If you cancel within 30 days of your arrival date, Peace of Mind Villa, LLC will retain 100 percent of your total rent as full liquidated damages.
DAMAGE DEPOSIT
There is a $1500 Damage Deposit which is fully refundable within 14 days of your departure, provided there is no breakage, damage, missing items, no additional cleaning for villa left abnormally dirty, long-distance calls charged to the villa’s telephone, internet or streaming charges, and no other charges incurred before, during or after your stay, still outstanding. All normal utilities (except for long-distance phone calls, internet or streaming charges, or careless/extreme/excessive use of your villa’s water supply or air-conditioning) are included in your rental price. You hereby agree to pay Peace of Mind Villa, LLC the cleaning or replacement costs for all damages to personal property or to the real estate, which may occur as a result of your occupancy, excluding normal wear and tear.
ARRIVAL ON ISLAND
At least 2 weeks before you travel POMVilla Manager, Lisa Butler, will need to know your

• Arrival and Departure Times
• Car Rental or Taxi Company
If your flight is delayed or canceled while en route, you are REQUIRED to contact POMVilla Manager so arrangements can be made for your altered arrival time/day.

CHECK-IN / CHECK-OUT TIMES
Check-in time is 4 PM, arriving early does not guarantee entry
Check-out time is 10AM or earlier.
Failure to check out of your villa at 10AM sharp may result in a $250 penalty charged to Guest.
Exceptions for early check-ins or late check-outs are sometimes possible, guest must previously arrange and confirm with POMVilla Management.
If you arrive earlier and if the schedule allows, you may be able to take your luggage to the villa carport area to be dropped-off but entrance to the villa will not be allowed, you must leave and return no earlier than 4pm unless previously arranged with POMVilla Management.
CAPACITY OF VILLA
The total number of persons allowed in the villa at any one time is restricted to the number of persons scheduled and paid for, based on two persons per bedroom with a maximum of 16 (sixteen) adults and 2 (two) infants. All persons count towards the headcount, including any infants. At time of booking, all villa Guests are required to provide Peace of Mind Villa, LLC with the full names and ages of all Guests staying in the villa. If Guest is found to have more persons than officially scheduled and paid for at the villa (including but not limited to event, party or any sort of group gathering) Guest is subject to forfeiture of entire villa security deposit at the discretion of Peace of Mind Villa, LLC and required to pay for all excess persons immediately, and/or shall vacate the villa immediately, without refund.
EVENTS AND PARTIES
Absolutely NO house parties or functions (party, weddings, corporate events, gatherings, etc.) are allowed without advance WRITTEN permission from Peace of Mind Villa, LLC.
QUIET ENJOYMENT
Guests are advised that noise travels easily and that it is important to be respectful of others at all times. There is a noise curfew of 9:00 PM in all residential areas and all Guests are expected to comply with this rule.
SECURING VILLA
When leaving the property be sure to close and lock all doors and windows. Property Gate must be closed and the security system armed when leaving the property, we recommend having the gate closed at all times for added security.
STAIRS
You must descend stairs to get to the lower level. Entryway, kitchen, media room and pool are on the main level with no steps required for access.
LOCKED CABINETS AND FURNITURE
Locked pantries and closets are not included in villa rental. Rearranging the furniture or removing any items from the villa is prohibited. You as the Guest agree to take all reasonable steps to ensure that all Guests in your party adhere to the rules and regulations affecting your villa.
VILLA SUPPLIES
Peace of Mind Villa is equipped with beach chairs, beach towels, a beach cooler, a packable beach blanket, hair dryers, and two safes. Villa is stocked with initial supplies only of toilet paper, paper towels, soaps, shampoo, laundry detergent, trash bags, shampoo and conditioner. It is the Guests’ responsibility to restock on their own once these supplies are depleted.
LINENS
Your villa has all required linens, bed covers, bath towels, and beach towels. Clean linens will be put out at the 10 day cleaning. We kindly ask that you help us to care for the towels and linens by washing off sun and make-up products completely before using any towels, terry or linens.
BABIES AND TODDLERS
Portable nylon baby crib (play-n-packet style) and highchair are available for use. We do not provide mattress pads or sheets for cribs. Always follow all assembly and safety instructions.
NO PETS
Pets of any kind are NOT allowed in or on the villa’s premises without specific written permission from Peace of Mind Villa, LLC being granted prior to arrival and will require an additional pet fee. A pet or evidence of a pet found on premises will cause immediate eviction, and forfeiture of Guest’s entire rent and deposit.
NO SMOKING
Peace of Mind Villa is a smoke-free villa. No smoking/vaping anywhere in the villa. You may smoke outside away from all open windows and doors, dispose of all smoking waste properly.
POOL AND POOL AREA
The Guest recognizes and fully understands certain things by use of the pool and/or pool area, including, at no time is there a lifeguard on duty. The Guest is responsible for the safe operation of the pool and is responsible for all persons using the pool and/or pool area during Guests stay. Guest agrees to the following rule for use of the pool and/or pool area:
No Glass of any kind is allowed in the pool or on the pool areas, broken glass in any of these areas will require the pool to be drained, cleaned and refilled at the expense of the Guest.
Guests will remove all sand and skin care products before entering the pool
VILLA REMOTES
Peace of Mind Villa, LLC shall charge Guest $200 charge for each lost or mishandled remote. Guest is required to follow all instructions precisely on where to leave your villa gate and electronics remotes when you depart – call POMVilla Manager if you are unsure.
GARBAGE REMOVAL
Guests are responsible for placing all trash (trash must be bagged) into the appropriate outside containers located on the driveway of POMVilla, do not leave bags on ground or place loose trash in bins. If trash is not removed from the villa and placed into the supplied garbage cans in the drive, the Guest may be subject to a $50 penalty.
CELL PHONES
Before traveling, please check with your cell phone service provider for coverage area and any roaming fees. Peace of Mind Villa, LLC is not responsible for any roaming fees or data overages you may incur while on-island.
SPECIAL SERVICES
We can arrange almost any special services you wish with ample advanced notice. You can discuss your needs and wishes with our POMVilla Manager Lisa Butler. She will give you details, costs and help in any way to make you stay wonderful.
GROCERY DELIVERY SERVICE
We can pre-stock your villa with the food and beverages of your choice. This service is well worth the cost, so you can settle in, unpack and enjoy your villa the moment you arrive.
IN-VILLA CHEF SERVICE
We have excellent chefs who are available for just one special dinner or daily meals. We will give you information that you may contact your island chef directly to discuss menus, dietary requirements and your grocery shopping list with him or her. Chefs will require an advance deposit for both grocery shopping and for their cooking; you may pay them directly. And please remember: all of our chefs book-up far in advance for all holidays, so please plan far in advance.
HOUSEKEEPING SERVICES
One “Hotel Style” cleaning service is provided for every 10 days of a booking, this service includes new linens, new towels and terries, general cleaning and tidying only; any personal laundry, dirty dishes, or other cleaning is not included in this service. Additional “Hotel Style” cleaning services and Maid Services can be provided for additional fees. Please request pricing for these needs before booking. Services must be arranged with POMVilla Manager Lisa Butler prior to the first deposit.
TIPPING THE VILLA’S STAFF
If you have enjoyed your stay and services in the villa, we recommend tipping your dedicated Villa Manager and your housekeeping staff. And if you have food and drink left in your villa when you depart, you may also leave these for the housekeeping staff – they will appreciate it.
COMPLAINTS AND MAINTENANCE
Peace of Mind Villa, LLC shall make every effort to keep the villa and its inventories in good working order and in excellent condition. In case of a maintenance problem, Peace of Mind Villa, LLC will strive to repair the problem as soon as possible after being notified.
It is the Guest’s obligation to report any problems or damage to the villa IMMEDIATELY to POMVilla Manager regardless of the hour.
We will make every effort to work with the various service providers to restore any interrupted service as quickly as possible. Peace of Mind Villa, LLC reserves the right to be allowed several hours (up to 24 hours) to cure a reported problem; however, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, internet service, water, pool systems, air conditioning, television or cable service, appliances, etc unless there is a serious problem that cannot be remedied within twenty four (24) hours, and/or causes the Guest extreme, undue discomfort or serious inconvenience. If the villa or any of its systems or amenities require service or repair the Guest will agree to make the villa or room available for the service technician and/or POMVilla Manager to perform any repairs as necessary; however, they will never enter the villa or the grounds around the pool deck without notifying you first. If your villa is on the market for sale, we reserve the right to allow the villa to be shown, but only by advance appointment made with Guests. We will make every effort to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your stay.
LIABILITY
Peace of Mind Villa, LLC (POMVilla) is acting hereunder as agent for accommodations, and assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa; or the acts of any company or persons engaged in services at the villa (chef, massage, transportation, etc.). Peace of Mind Villa, LLC (POMVilla) assumes no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Furthermore, Guest is responsible for his villa during occupancy, must close the villa gate, lock villa’s windows and doors securely at all times when not on the premises, and must exercise care in securing all personal property. Guests must observe all cautions as given in our e Guide / Guest Booklet and/or by Property Manager.
INDEMNIFICATION/HOLD HARMLESS
The Guests agree to defend, indemnify and hold harmless Peace of Mind Villa, LLC (POMVilla) and represented property owner from and against all claims, demands, loss, liability of any kind and character, including cost of defense, arising out of or in any way connected with the tenant’s use of the property: in the event tenants or Guests suffer personal/physical/property damage, injury, or loss. Peace of Mind Villa, LLC (POMVilla) and property owners are not responsible for lost or stolen items or physical security. The duty to defend arises when the claim or demand is first made and is not waived by a delayed tender of defense. ‟You agree to indemnify, defend, and hold harmless Peace of Mind Villa, LLC (POMVilla) and its directors, employees, sponsors, licensors, independent contractors, providers, subsidiaries and affiliates (collectively, the “Indemnified”), from and against any and all liability costs (including attorney’s fees and costs) incurred by the Indemnified in connection with any claim arising out of any breach by you of any provision of this User Agreement. You agree to cooperate as fully as reasonably required in defense of any such claims. Peace of Mind Villa, LLC (POMVilla) reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any claim without the written consent of Peace of Mind Villa, LLC (POMVilla). Any dispute arising out of these rental terms or this rent agreement, shall be construed and interpreted in accordance with the laws of the Territory of the US Virgin Islands without resort to the conflicts or choice of law principles thereof. The Courts of the United States Virgin Islands, Division of St. Thomas, shall be the exclusive venue for all judicial disputes and the prevailing party shall recover its costs, expenses and reasonable attorneys’ fees.
Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed above and authorizing Peace of Mind Villa, LLC (POMVilla) to apply any penalties or additional costs to the credit card on file.
